1. Acceptance of Terms

By accessing or using nontoxco.com ("the Site"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Site. We reserve the right to update these Terms at any time. Changes take effect when posted, and your continued use of the Site constitutes acceptance of updated Terms.

2. About NonToxCo

NonToxCo ("we," "us," or "our") operates an online store selling non-toxic alternatives to everyday household products. We ship within the United States only. Our products are sourced from third-party suppliers and fulfilled through our dropshipping partners.

3. Eligibility

You must be at least 18 years old to make a purchase on the Site. By placing an order, you represent that you are at least 18 years of age and that the information you provide is accurate and complete.

4. Products and Descriptions

We make reasonable efforts to display product descriptions, images, and materials accurately. However, we do not guarantee that descriptions are error-free, complete, or current. Colors may vary slightly due to monitor settings. We reserve the right to modify product offerings, pricing, and availability without prior notice.

Product materials are described based on information provided by our suppliers. While we vet our suppliers and their material claims, we rely on supplier-provided specifications for material composition details.

5. Pricing and Payment

All prices are listed in US dollars and are subject to change without notice. We are not responsible for pricing errors. If an item is listed at an incorrect price, we reserve the right to cancel orders placed at the incorrect price and notify you of the cancellation.

Payment is processed securely through Shopify Payments. We do not store your credit card information on our servers. By placing an order, you authorize us to charge the payment method provided for the total order amount, including applicable taxes and shipping fees.

6. Shipping and Delivery

We ship to addresses within the United States only. Orders are fulfilled by our third-party suppliers through Spocket. Estimated delivery times are provided as guidelines and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs, weather, or other circumstances beyond our control.

Risk of loss and title for items pass to you upon delivery to the carrier. If a package is lost or damaged during shipping, please contact us at hello@nontoxco.com so we can work with the carrier and supplier to resolve the issue.

7. Returns and Refunds

If you are not satisfied with your purchase, you may request a return within 30 days of delivery. Items must be unused, in original packaging, and in resalable condition. To initiate a return, contact us at hello@nontoxco.com with your order number.

Refunds are processed to the original payment method within 5 to 10 business days after we receive and inspect the returned item. Return shipping costs are the responsibility of the customer unless the item arrived damaged or defective.

Some items may not be eligible for returns due to hygiene or safety reasons (for example, baby products that have been opened). These exceptions will be noted on the product page.

8. Health and Safety Disclaimers

The content on our Site, including blog posts, product descriptions, and the "Is It Safe?" tool, is provided for informational and educational purposes only. It is not medical advice, and it is not a substitute for professional medical, health, or safety guidance.

13. Dispute Resolution

Any dispute arising from these Terms or your use of the Site shall first be attempted to be resolved through informal negotiation by contacting us at hello@nontoxco.com. If a dispute cannot be resolved informally within 30 days, either party may pursue resolution through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in the State of Delaware.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, class arbitration, or representative proceeding.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
